These Terms govern your purchase of artwork, handmade goods, commissioned work, workshops, and services from Kat Knutsen Studios LLC (“Kat Knutsen Studios,” “we,” “us,” “our”). By placing an order you agree to them. Please read the commission and return sections carefully. They contain the terms most likely to affect you.

1. Who you are buying from

Kat Knutsen Studios LLC is a limited liability company organized in the Commonwealth of Massachusetts.

2. Orders, pricing, and payment

Placing an order is an offer to buy. Your order is accepted when we send an order confirmation or ship the item, not at the moment of payment. We may decline any order, including after payment, for any lawful reason. If we decline, we refund you in full.

Prices are in U.S. dollars and may change at any time, but changes never affect an order already accepted. Payment is taken at checkout through our payment processor; we do not store your full card details.

We try hard to keep listings accurate. If an item’s price, description, or availability is materially wrong, we may cancel the affected order and refund you in full rather than honor the error.

Applicable Massachusetts sales tax is calculated at checkout.

3. Original artwork

Each original painting is one of a kind. Inventory is genuinely limited to a single piece, and once sold, that work cannot be reordered.

Screens vary. Color, surface texture, and scale can read differently in person than on your monitor. We photograph work as faithfully as we can, and reasonable variation between the photograph and the physical painting is not a defect.

Dimensions listed are of the artwork itself and do not include framing unless expressly stated.

Copyright stays with the artist. Buying an original painting transfers the physical object only. Kat Knutsen retains all copyright and reproduction rights in the image, including the right to photograph the work, display it in a portfolio, and produce prints or other reproductions. You are welcome to display and resell the physical work; you may not reproduce it commercially without written permission. See Section 10.

4. Handmade goods

Hats and other handmade items are made individually. Variation in color, dimension, texture, and finish is inherent to handmade work and is part of what you are buying, not a fault.

Where sizing is offered, please consult the listed measurements. Because these are made by hand, sizing is approximate.

Massachusetts exempts the first $175 of an item of clothing from sales tax and taxes only the portion above that; tax is applied at checkout according to the rules in effect at the time of your order.

5. Commissioned work

Commissions, including portraits, murals, and illustration, are custom goods made specifically for you. This section governs them, and it takes precedence over the general return policy in Section 7.

5.1 What your purchase books. Purchasing a commission reserves a place in the studio schedule at the tier you selected. It is the start of the project, not the final agreement on its scope.

5.2 Scoping. Within five business days of your order, we will contact you to gather reference materials and agree on subject, composition, size, and delivery expectations.

If, after that conversation, the work you want falls outside the tier you purchased (significantly more figures, a substantially larger canvas, an unusually compressed deadline), we will quote the difference before beginning. You may accept the revised quote, adjust the scope back down, or cancel for a full refund.

We may also decline a commission for any lawful reason, including subject matter we are not the right artist for or a schedule we cannot honor. If we decline, you receive a full refund. No work is owed until scope is agreed in writing.

5.3 Reference materials. You are responsible for supplying usable reference photographs or arranging sittings. Poor reference materially affects what is achievable, and we will tell you plainly if what you have sent is not workable.

By supplying reference material you confirm you have the right to use it and to authorize a painting based on it, and that you have the consent of any identifiable living person depicted. You agree to cover any third-party claim arising from reference material you supplied. A professional photographer’s copyright is the usual issue.

5.4 Approval and revisions. Commissions proceed in stages. You will be shown a preliminary sketch or composition study for approval before painting begins. One round of revisions is included at the sketch stage. Changes requested after painting has begun may incur additional charges quoted in advance.

Portraiture is interpretive. Dissatisfaction with the artist’s style, brushwork, or interpretation is not grounds for refund. An agreed and documented factual error, such as the wrong eye color, is a different matter.

5.5 Timelines. Estimated completion dates are good-faith estimates, not guarantees. Commissioned painting is affected by drying times, materials, and the studio schedule. We will keep you informed of meaningful delays. If a firm deadline matters to you, say so during scoping so we can confirm in writing whether it is achievable.

5.6 Cancellation and refunds on commissions.

• Before scope is agreed — full refund.
• After scope is agreed, before work begins — full refund less a 15% scheduling fee.
• After work has begun — no refund; work in progress remains our property.

Because commissioned pieces are made to your specification, they are exempt from the standard return window. Once painting has begun, materials are consumed and studio time is committed. If we cancel for any reason other than your breach of these Terms, you receive a full refund.

5.7 Ownership of commissioned work. Copyright in commissioned work remains with Kat Knutsen unless separately agreed in writing. You receive the physical piece and the right to display it. We reserve the right to photograph completed commissions and show them in a portfolio, on social media, and in exhibitions. If your commission is private and you would prefer it not be shown publicly, tell us during scoping and we will honor that in writing.

6. Shipping and delivery

We ship within the United States at a flat rate of $65 per order, whatever the size of the work. Original paintings are packed by hand and shipped insured; that rate reflects real crating, packing, and insurance costs rather than a carrier’s box price.

International shipping is not offered at checkout. If you are outside the United States and want a piece, email us and we will quote it; any customs duties and import taxes are yours to pay.

Title and risk of loss pass to you on delivery to the carrier. But if a work arrives damaged, tell us within 5 days with photographs of the item and its packaging so we can pursue the insurance claim. Please keep all packing materials until a claim is resolved.

Delivery estimates are estimates. We are not responsible for carrier delays.

Local pickup is free at the studio in New Bedford. Choose it at checkout and we will email you when the piece is ready, usually within 2–4 days, to arrange a time.

7. Returns and refunds

• Original artwork — 14 days from delivery. Unaltered and undamaged, in original packaging. Buyer pays return shipping and insures the return. Refund issued on safe arrival, less original shipping.
• Handmade goods — 30 days from delivery. Unworn, unwashed, with tags. Buyer pays return shipping.
• Commissioned work — not returnable. See Section 5.6.
• Workshops and sessions — see Section 8.
• Consulting and event services — not returnable once delivered.

Request a return by emailing kat.knutsen@gmail.com before sending anything back. Returns sent without notice may not be refundable. Items damaged in return transit are your responsibility, which is why we ask you to insure the return. None of this limits your rights where damaged or misdescribed goods are concerned.

8. Workshops, sessions, and consultations

Workshops and figure drawing sessions are sold per seat and may have minimum enrollment.

• Cancel more than 7 days ahead — full refund or transfer to a future session.
• Cancel within 7 days — transfer to a future session, no refund.
• No-show — no refund or transfer.
• If we cancel — full refund or transfer, your choice. This covers insufficient enrollment, model unavailability, weather, or anything else.

Consultations are billed by session. Rescheduling with at least 24 hours’ notice is free; later than that, the session is forfeit. Materials are yours to bring unless a listing says otherwise. You attend at your own risk and are responsible for your own conduct and belongings.

9. Event coordination and management

Event work is quoted individually and governed by a separate written agreement covering scope, milestones, and payment schedule. Where that agreement and these Terms conflict, that agreement controls. Deposits for event work are non-refundable once planning begins, as they reserve capacity that is then unavailable to others.

10. Intellectual property

All artwork, images, text, designs, and site content are the property of Kat Knutsen Studios LLC and are protected by copyright.

Selling a physical work does not transfer copyright. You may not reproduce, print, scan, distribute, or use any artwork commercially without written permission. That includes merchandise, advertising, packaging, and logos.

Nor may our images be used to train machine learning or generative AI systems.

Personal enjoyment, display in your home or business, and non-commercial photographs of the work in your space are all fine.

11. Limitation of liability

To the fullest extent permitted by Massachusetts law, our total liability arising from any order is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential damages such as lost profits or lost opportunity.

Nothing here limits liability for fraud, willful misconduct, personal injury caused by our negligence, or anything else that cannot lawfully be limited.

12. Site content and availability

We aim for accuracy but do not warrant that the site is error-free or continuously available. Content may change without notice. The site may link to third parties; we are not responsible for their content or practices.

13. Privacy

Our handling of your information is described in our Privacy Policy, which forms part of these Terms.

14. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Disputes are subject to the exclusive jurisdiction of the state and federal courts of Bristol County, Massachusetts.

Before filing anything, please email us. Nearly everything is resolvable directly, and we would rather fix a problem than argue about it.

15. Changes

We may update these Terms. The version in effect when you place your order governs that order. Material changes will be reflected in the date above.
